In accordance with the provisions of the Law on personal data protection, attorney Dragan Ranđelović, with registered place of business at Kej Kola srpskih sestara 13/27, 18000 Niš, registration number 56119051, in capacity of the data controller (hereinafter “Controller”) hereby informs the users of the website (hereinafter “Data subjects”) available at randjelovic.rs about data processing activities and users’ rights.

PURPOSE AND LEGAL BASIS FOR DATA PROCESSING

We do not collect or process your personal data when you access our website at randjelovic.rs (hereinafter “Site”). In the event that you contact us using the contact information available on the Site we will collect and process the personal data that you provide us or make available to us, such as your phone number, email address, first and last name as well as any other date that you provide in communication. We use this personal data in order to reply to your inquiries and to comply with your requests, all in accordance with the Law on personal data protection (LPDP), Law on attorneys, and Code of professional ethics of attorneys. Depending on the purpose of the processing, the legal grounds for processing of personal data may include:

  • Consent (article 12. Paragraph 1. Point 1 of the LPDP)
  • Performance or preparation of the contract (article 12. Paragraph 1. Point 2 of the LPDP)
  • Compliance with legal obligation (article 12. Paragraph 1. Point 3 of the LPDP)

RECIPIENTS OF THE PERSONAL DATA

Controller acts in accordance with client’s requests with regard to their personal data. In this regard, Controller may only share personal data if instructed or authorized by the data subject. Other attorneys and practitioners may be involved in performance of the contract with the client, each under the same level of data protection obligation as the Controller, to whom personal data may be disclosed for the purposes of providing the services to the data subject.

DATA WHICH MAY NOT BE USED TO IDENTIFY THE DATA SUBJECT

The Site uses cookies which represent small files which are recorded in the Data subject’s browser when visiting the Site. There are different types of cookies, some of which record personal data while others do not. Our Site currently uses only one cookie „pll_language“ which does not process personal data and is only used to remember the language of the Site the Data subject chose and which will be displayed the next time you visit the Site. This information may not be used to identify an individual Data subject and is only used to customize the Site content at the Data subject’s request. 

DATA RETENTION PERIOD

Controller is obliged to keep the personal data in accordance with the deadlines in the legal provisions on the keeping of archive data. With regard to personal data for which no deadline is prescribed, Controller will only keep it for as long as it is strictly necessary to perform the purpose for which they are collected. Data subject may at any time request erasure of their personal data.

DATA SUBJECTS’ RIGHTS

Data subjects have a right to seek access, rectification, and erasure of their personal data, as well as rights to restriction of processing, objection, and data portability.

Where personal data is processed in accordance with the consent, Data subject has a right to withdraw the consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

Data subject also has the right to lodge a complaint with the Commissioner for information of public importance and personal data protection if they consider that any of their rights under the Law on personal data protection have been violated.

REQUIREMENT TO PROVIDE PERSONAL DATA

In accordance with the Law on attorneys, and Code of professional ethics of attorneys, before providing the services the attorney is responsible to confirm the identity of the client. In case personal data is not provided an attorney may not enter into contract with the Data subject. 

In the event that the personal data is provided under consent, Data subject will not suffer any consequence for withholding such personal data other than the fact the they will not be able to enjoy the benefits awarded to Data subject who provide their data.

FINAL PROVISIONS

Where the Controller intends to further process the personal data for a purpose other than that for which the personal data were collected, the Controller shall provide the Data subject prior to that further processing with information on that other purpose and legal grounds prior to commencing the processing activity.
